Directions Concerning Paying for the Use of GIO-produced Works

 
Article 1:

To use any oral and literary works, artistic works, or photographic or audiovisual works to which the Government Information Office of the Executive Yuan (hereinafter referred to as the GIO) holds the intellectual property rights the user shall file an application with the GIO.

To use works mentioned in the preceding paragraph for which the GIO has appointed a third party to handle licensing issues the user shall consult with the third party directly.

Article 2:

Upon receipt of GIO authorization of use, a user shall pay remuneration in accordance with the Appendix. This requirement does not apply to a use that conforms to any of the circumstances listed in Article 3.

Article 3:

Under the following circumstances, remuneration is waived:

  1. A non-profit user uses said works to serve the public interest, publicize government policies, or meet other official needs.
  2. Said works are used to publicize the Republic of China internationally.
  3. Complimentary cross licensing of intellectual property rights is agreed upon between the GIO and a user.

Note: In case of any discrepancy between the Chinese original and this English translation, the Chinese text shall prevail.

Appendix:

  1. Reproduction, publication or public transmission of oral and literary works to which the GIO holds the copyright:

(1) Works are calculated by the word at NT$1,000 (all fees are denominated in New Taiwan dollars) per every one thousand words. Works that are less than one thousand words will be counted as one thousand words.

(2) The period of licensing shall not exceed one year (during this period, there is no restriction on the number of copies or printings, as well as the number of public transmissions). During this period, the license to use the work is not transferable to other parties. In addition, the licensee can only use the work within the stipulated scope of authorization and must note the source of the work.

  1. Audiovisual materials to which the GIO holds the copyright that are used in part to produce audiovisual works for reproduction, issuance, public presentation, public broadcast or public transmission:
  • Reproduction and issuance license for home use:
  • Fee is NT$1,000. The fee is triple for high resolution.
  • Remarks:
  1. Licensing fees are based on the number of minutes, with each minute being one unit. Anything less than one minute is calculated as one minute.
  2. The licensing period shall not exceed one year. There is no limit on the number of reproduction or issuance during this period.
  3. The license is non-transferable.
  4. Use is limited to the scope permitted under the license.
  • Public presentation license for programs:
  • NT$2,000. The fee is triple for high resolution.
  • Remarks:
  1. Licensing fees are based on the number of minutes, with each minute being one unit. Anything less than one minute is calculated as one minute.
  2. The licensing period shall not exceed one year. There is no limit on the number of public presentation during this period.
  3. The license is non-transferable.
  4. Use is limited to the scope permitted under the license.
  • Public presentation license for public service announcements and advertisements:
  • Fee is NT$1,000. The fee is triple for high resolution.
  • Remarks:
  1. Licensing fees are based on the number of seconds, with each 10 seconds interval being one unit. Anything less than ten seconds is calculated as ten seconds.
  2. The licensing period shall not exceed one year. There is no limit on the number of public presentation during this period.
  3. The license is non-transferable.

  • Public broadcast license for television (terrestrial, cable, and satellite) programs:
  • NT$4,000. The fee is triple for high resolution.
  • Remarks:
  1. Licensing fees are based on the number of minutes, with each minute being one unit. Anything less than one minute is calculated as one minute.
  2. The licensing period shall not exceed one year. There is no limit on the number of public broadcasts during this period.
  3. The license is non-transferable.

  • Public broadcast license for public service announcements and advertisements

  • Public broadcast license for domestic and overseas television (terrestrial, cable, and satellite)
  • NT$90,000. The fee is triple for high resolution.
  • Remarks:
  1. Licensing fees are based on each film or series, with each 30 minutes period being one unit. Anything less than 30 minutes is calculated as 30 minutes.
  2. The licensing period shall not exceed one year. There is no limit on the number of public broadcasts during this period.

  • Public transmission license
  • NT$9,000. The fee is triple for high resolution.
  • Remarks:
  1. Licensing fees are based on each film or series, with each 30 minutes period being one unit. Anything less than 30 minutes is calculated as 30 minutes.
  2. The licensing period shall not exceed one year. There is no limit on the number of public transmissions during this period.
  3. The license is non-transferable.

  1. Photographic works (photographs, slides and image files):
  • License for advertisements, posters, calendars, stamps, and cards is NT$5,000 per piece
  • License for magazine front covers and back covers is NT$4,000 per piece
  • License for magazine inside covers is NT$2,000 per piece
  • License for newspapers and magazines is NT$1,000 per piece
  • Remarks for above licenses:
  1. The license is for one year and is single use.
  2. The license is non-transferable.
  3. Use is limited to the scope permitted under the license.
  4. An additional fee for reproduction of image files is NT$100 per piece, with the applicant responsible for payment of fees.
  • License for electronic publications is NT$1,000 per piece
  • License for public transmission is NT$1,000 per piece
  • License for textbooks is NT$500 per piece; or NT$1,000 per piece for front covers or back covers
  • License for Printed publications other than textbooks is NT$1,000 per piece; or NT$2,000 per piece for front covers or back covers
  • License for briefs is NT$500 per piece
  • Remarks for above licenses:
  1. The license is for one year and is single use.
  2. The license is non-transferable.
  3. Use is limited to the scope permitted under the license.
  4. Reproduction or editing of textbooks must be in accordance with Article 47 of the Copyright Act.
  5. An additional fee for reproduction of image files is NT$100 per piece, with the applicant responsible for payment of fees.
